COURSE DESCRIPTIONS:
Expungements: In the last several years the expungement of adult criminal records has become one of the most complex areas of data practices, records management and records response for criminal justice agencies. This class is built upon and expands the half day basic expungement class, but you do not have to attend the basic class to find this information useful. Topics included are the processing booking record destruction requests under Minn. Stat. 299C.10 and the various statutes concerning adult expungement by petition and court order, expungement based on prosecution consent, cannabis and drug related expungements, expungements based on inherent judicial authority and the largest and newest statutes on the subject of the so-called "automatic expungement" or Clean Slate Act. We will discuss responding to petitions or requests for expungement, how to litigate and defend against expungement petitions, processing expungements directives from courts and BCA, responding to records requests when sealed records are involved, records retention and data practices issues. Bring your questions, concerns and comments. Course materials will include sample documents and templates and relevant statutes.
